Series of Lectures on the Law of Land Management, Urban Planning and Landscape of the Valencian Community (LOTUP)

Broseta_LOTUPOn January the 30th the Public Law Department of BROSETA lawyers held, in the  Manuel Broseta Pont lecture theatre, the fourth session in the cycle of conferences which, since last October, it has been organizing in relation to the recent law 5/2014 of the Valencian Community. The session was presented by Ramiro Cervera, senior lawyer of the Department and Conference Coordinator, and also saw the attendance of Manuel J. Domingo Zaballos, the Contentious-Administrative Judge and Secretary of the Local Administration on sabbatical.

The session, entitled “urban building from the double perspective of faculty and duty; the license and the regime of compulsory construction in the LOTUP” focused mainly on the regulation of planning permissions in the new planning law, as well as other concepts of Administrative control of Planning Law (responsible statement, license of temporary works and use, licensing of interventions). These instruments, mainly planning permission, were analyzed taking into account its double aspect as a generator of rights to its holder, but also as a tool to impose duties on them.

Many attendees (many of them belonging to the major municipalities of the province) discussed issues of great practical importance such as, in the case of the license of intervention, what scope should there be for technical control, how they coordinate licenses with the integrated environmental authorisation procedures or changes made by the LOTUP in the regime of compulsory building for cases in which the period provided for in the plan has elapsed but they have not started construction works.
