Sergio Baches publishes the article “Inspections and competition”
BROSETA Partner and Head of the Competition and EU Law Department, Sergio Baches, analyses for Expansion the recent judgement of the Spanish Supreme Court that allows the National Commission for Markets and Competition to open a case on the basis of evidence or documents that have been obtained accidentally during an inspection, despite de fact that those evidence or documents refer to a potential infringement beyond the scope of the investigatory order or court warrant authorizing the dawn-raid.
